Bookings:
All bookings, changes of bookings and cancellations should be made in writing by using email, fax or normal letter which will be confirmed by Holiday Tours Ltd. Should the selected activity (accommodation, transportation or any other activity) be available at the time of booking, if there is unavailable, alternative arrangements will be offered. Booking is confirmed with a Holiday Tours Ltd. booking number and the booking number should be used in further correspondence with Holiday Tours Ltd.
Cancellation:
In case of cancellation of confirmed booking, we reserve the right to charge a nominal cancellation fee of services and expenses in accordance to those fees charged to us. Cancellation fees are percentage of the total booking price, if not agreed otherwise.
Cancellation terms for groups:
Up to 31 days prior to arrival, 20 € in administrative fee
30-22 days 25% of total booking price
21-15 days 60% of total booking price
14-11 days 80% of total booking price
10 days-no show 100% of total booking price
Exception:
- For group bookings starting from 16 rooms Holiday Tours Ltd. shall have the right to impose separate prices, payment and cancellation terms.
- In case the booking fails to meet the requirements for groups, Holiday Tours Ltd. shall have the right to impose the prices, payment and cancellation terms applicable for individuals.
Cancellation terms for individuals:
Up to 15 days prior to arrival: 20 € in administrative fee
14-3 days: 50% of total booking price
48 hours - no show 100% of total booking value
The effective date from which the days to arrival will be counted is the day when Holiday Tours has received the written cancellation notice. The effective dates can be Mon to Fri from 9:00 AM to 5:00 PM Estonian time (GMT + 2 hrs at winter and GMT + 3 hrs at summer) except public holidays.
Changes of dates and reductions in group size are considered to be cancellations unless otherwise agreed in written form.
THE RESPONSIBILITIES OF THE TOUR OPERATOR
is to guarantee that the tour answers to the description and the promises given to the Client.NB! Included in the package price are the services presented in the written offer. If the Client does not use one or some of the services included in the price he or she does not have the right to ask for a refund.
THE TOUR OPERATOR CANNOT BE HELD RESPONSIBLE
1) for force majeure (including natural disasters, political incidents, strikes, etc.);
2) for the damages which come into being because of the Client's fault;
3) if the client falls a victim of a crime;
4) if the client falls ill;
5) for the conditions not subordinate to the control of Holidays Tours Ltd. (e.g. the change of fuel prices, taxes, etc.).
THE TOUR OPERATOR'S RESPONSIBILITY LIMITS
The Tour Operator is not an immediate service offerer but only an authorized reseller. Therefore it is not in the power of the Tour Operator to answer for the quality and quantity of the service which is provided by another company (transportation, accommodation, etc.). If the client is not satisfied with the provided service or the service does not answer to the documents given to the Client by the Tour Operator, the Client must first hand in the complaint to the provider of the service. If there is no reaction to the Clients complaint or it is refused to provide the required service then the Client should hand in a written complaint to the Tour Operator 10 days at the latest after returning from the journey. If the Client wishes to get compensation for not received or unsatisfied service from or by the help of the Tour Operator the Client must add to the complaint the originals of the receipts about the well-founded additional expenses, which are wished to be compensated. Monetary demands which are not related directly to the expenses the Tour Operator will not compensate.
THE RESPONSIBILITIES AND OBLIGATIONS OF THE CLIENT
1) The Client is obligated to check the travel documents and in case of a mistake notify the Tour Operator immediately.
2) during the journey the Client has to follow all the rules and instructions given by the Tour Operator or its authorized representative, also the regualtions of the accommodation company and transportation means and the prescriptions of the authorities. If the Client discharges the above mentioned obligations then the Tour Operator has the right to finish the Contract ahead of time and demand the compensation of the damages from the Client. All the costs regarding to the trip back home will be paid by the Client.
3) The Client is responsible for the damages made by careless action or lack of action to the Tour Operator, fellow-travellers or other persons (including accommodation and transportation company, etc.).
4) The Client is self-responsible for getting travel insurance before the traveller leave their home. For many travellers this is a reqirement before entering to the EU.
THE CLIENT HAS THE RIGHT TO:
1) get information about the whole travel program (itinerary, accommodation, transportation);
2) to cancel the booking with a reasonable excuse which is disease, accident, death of the Client or his/her close relatives, other serious accident, etc. by presenting a written certificate, at the same time paying for the direct expenses bound to the change of the booking (hotel fine, etc.).
THE TOUR OPERATOR HAS THE RIGHT:
1) to cancel the journey if the number of travellers is smaller than the minimal number needed to organize the journey. If the Client does not wish to have a substitute journey then the Tour Operator returns all the money paid;
2) to end the Contract if the Client has not paid for the journey by the agreed time.
The present terms of the Contract will become obligatory to both parties after concluding the Contract.
Rates:
All rates are net (commissionable if agreed), and include all taxes. Prices are subject to changes without prior notice when factors occur beyond our control. Therefore they are subject to our final confirmation at the time of booking - once the booking is confirmed, they can not be changed.
Vouchers:
All customers and group leaders should have a separate voucher for each service wich provides Holiday Tours Ltd. Vouchers should state all details of the booking and the remark Booked and payable via Holiday Tours Ltd.
Hotel customers should leave their accommodation vouchers to the hotel reception. For all the extra services provided by the hotel, customers have to pay directly to the hotel on departure.
Payment:
Unless otherwise agreed, full payment for the requested services for groups is required 25 working days prior to arrival; full payment for the services for individuals is required 15 working days prior to arrival. Payment should be forwarded to our bank account in Estonia or by using the online payment system indicated in the invoice no later than the invoice due date. All bank charges (domestic and foreign) are to be paid by the payer (Full payment to the recipient). The online payment with VISA and MasterCard are subject to fees set by the payment service.
Holiday Tours Ltd. reserves the right to cancel the reservation/program in the event of non-payment.
Liability:
In all travel arrangements Holiday Tours Ltd. acts as a contract agent for providing hotel accommodation or other tourist services. Holiday Tours Ltd. therefore assumes no liability in cases of accident, loss, delay or interference with the tour by “force majeure” or other events beyond our control.
By making a booking to Holiday Tours Ltd., the buyer recognises and accepts all terms and conditions stated above. By receiving a confirmation from Holiday Tours Ltd. both parties are engaged in a contract in which Holiday Tours Ltd. is responsible for delivering the service described in respective correspondence and the buyer is responsible for paying for the service without delay or deductions.
